New Delhi: Foreign nationals, including a large number of Indians, are encountering increased challenges due to stricter immigration policies enforced by the United States. Confusion has grown among Indian applicants as appointments for H-1B and H-4 visas are already facing delays caused by enhanced social media screening and additional regulatory checks.

Against this backdrop, the US government has released an important advisory aimed at Indian nationals currently residing in the country. Authorities have made it clear that any breach of US laws could lead to criminal prosecution, monetary penalties, or both. The administration has reiterated its firm stance on curbing unlawful immigration while prioritizing border security and public safety. In this connection, the US Embassy in India issued a public warning through an official social media post, urging compliance with American laws.

At the same time, significant changes to the H-1B visa framework have been officially confirmed. The US Citizenship and Immigration Services has introduced a revised visa allocation model, as published in the Federal Register. The updated system will be implemented starting February 27, 2026, and will apply to the H-1B cap registration cycle for the fiscal year 2027.

Under the new rules, H-1B visas will no longer be granted through a random lottery system. Instead, preference will be given to applicants offering higher wage levels and possessing advanced skills. This shift is expected to significantly affect many migrant workers, particularly those in lower-paid or entry-level positions, who may now face reduced chances of selection.

Additionally, the US Department of Labor has updated wage regulations governing H-1B employment, aligning compensation standards with the revised visa framework. These measures reflect a broader policy move toward prioritizing high-skilled and higher-earning professionals within the US workforce.
