National Herald Case: ED Approaches Delhi High Court, Notices Sent to Sonia and Rahul Gandhi

New Delhi: A significant new development has emerged in the National Herald matter. On Monday, the Enforcement Directorate (ED) moved the Delhi High Court, contesting a recent decision passed by the trial court regarding the ED chargesheet. Following this, the High Court issued notices to senior Congress leaders Sonia Gandhi, Rahul Gandhi, and other individuals linked to the case.

Representing the ED, Solicitor General Tushar Mehta informed the court that the agency has concluded its investigation. He stated that evidence has been gathered and searches were carried out at multiple locations during the probe. He further contended that the lower court made an error by not taking the ED chargesheet into consideration. The High Court has scheduled the next hearing for March 12, 2026.

Earlier, on Tuesday, a Delhi court declined to take cognizance of the chargesheet submitted by the Enforcement Directorate in the National Herald case. The court dismissed the chargesheet, with Special Judge Vishal Gagne stating that the ED complaint was based on a private complaint filed by Subramanian Swamy rather than an FIR registered in the matter. Under existing legal provisions, the judge noted that such an investigation could not proceed in this manner.

The court also observed that the Economic Offences Wing (EOW) of the Delhi Police had already registered an FIR in connection with the case. Given this situation, the judge said it would be premature to arrive at any conclusion solely based on the ED chargesheet. However, the court allowed the ED to continue its investigation.

The ED chargesheet names Sonia Gandhi, Rahul Gandhi, Suman Dubey, Sam Pitroda, Young Indian, Dotex Merchandise, and Sunil Bhandari as accused in the case.
